Definitions
Terms used in these Terms and Conditions, unless expressly stated otherwise in the text of the Terms and Conditions, have the following meanings:
Administrator – the administrator within the meaning of Article 4(7) of RODO is the Foundation for Central and Eastern Europe Development with its registered office in Lublin, Hugo Kołłątaja 3/15, 20-006 Lublin, registered in the National Court Register by the District Court Lublin- East in Lublin, with its seat in Świdnik, VI Division of the National Court Register, under KRS number: 466446, REGON: 061571146, NIP: 946-264-44-46
Foundation – the Foundation for Central and Eastern Europe Development with its seat in Lublin, Hugo Kołłątaja 3/15, 20-006 Lublin, registered in the National Court Register by the District Court Lublin- East in Lublin, with its seat in Świdnik, VI Division of the National Court Register, under KRS: 466446, REGON: 061571146, NIP: 946-264-44-46
Regulations – these regulations, available at https://fresw.pl, defining the rules of purchasing the Services offered by the Foundation at https://fresw.pl, as well as phone and e-mail orders
Foundation Website, Site – the website available at https://fresw.pl,
User, Customer – any person (whether a natural person, legal entity, or organizational unit without legal personality), using the Site.
Shopping Cart – a functional element of the Site that allows the Customer to make purchases through the website https://fresw.pl.
Service – a consultation or training service available from the Foundation.
Conditions for using the Foundation’s services
Procedure for placing an order:
A prerequisite for accepting an order is prior reading and acceptance of these Terms and Conditions.
The customer places an order through:
https://fresw.pl website;
sending an e-mail message to biuro@fresw.pl, providing the following information in the aforementioned message:
– the ordered service,
– quantity of the ordered Goods,
– name, surname or company name, address, telephone number, e-mail,
– Tax identification number – if the order is placed for a company;
by phone – by making a phone call to 536 536 528 from Monday to Friday from 9:00 a.m. to 5:00 p.m. and providing the following information in the phone call:
– the service ordered,
– quantity of the ordered Goods,
– name, surname or company name, address, telephone number, e-mail,
– Tax Identification Number – if the order is placed for a company;
The prices of the Services offered on the Site are placed next to the particular Service. All prices provided on the Site are expressed in Polish zloty. The Foundation is exempt from VAT in accordance with Article 113 paragraph 1 of the Act of March 11, 2004 on tax on goods and services (Journal of Laws 2022.0.931 t.j.)
The price of the Service specified on the Foundation’s Site at the time of placing an order by the Client is the binding and final price.
Payment
The Client is obliged to pay for the ordered services in the form of a prepayment or by bank transfer within 7 days from the date of placing the order or within another period separately agreed upon by the Foundation and the Client.
Failure by the Client to make a prepayment within the required period will result in the Foundation not proceeding with the Service.
The Client may pay the remuneration for services rendered to the Foundation by placing an order through the online store on the Foundation’s Website or by wire transfer to the Foundation’s account No. 56 1140 2004 0000 3902 8044 4247
Payment processing
The entity providing online payment service for card payments is Blue Media S.A.
Payment forms
Available forms of payment: Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro
Processing time
Services are performed within the timeframe indicated by the Client when placing an order via the Site, or within the timeframe agreed upon by the Foundations and the Client in the case of orders placed by email or telephone. In the absence of agreement on other payment terms, the execution of the Service cannot take place before the prepayment is made by the Customer.
Liability of the Foundation
The Foundation’s liability for incorrect or defective performance of the Service shall be limited to the amount of the actual damage suffered by the Client and shall not exceed the Foundation’s remuneration for the performance of the Service in question. The above limitation shall not apply to a Client who is an individual concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of the regulations on the Central Register and Information on Business Activity.
In the event that it is not possible to perform the Service on the date selected by the Client when placing the order on the Site or on the date agreed upon when placing the order by e-mail or telephone, the Client will be informed immediately. The Foundation will propose alternative dates for the performance of the Service. If none of the dates proposed by the Foundation suits the Customer, the Customer has the right to withdraw from the contract.
Withdrawal from the contract
A customer who is an individual who enters into an agreement directly related to his/her business activity, when from the content of the agreement it follows that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity, may withdraw from the concluded agreement without giving any reason within 14 days from the date of placing and paying for the order, provided that the Foundation has not proceeded with the service. Withdrawal from the contract can be made by submitting a statement electronically to biuro@fresw.pl. If you have any questions, please contact tel: 536 536 528 from 9:00 – 17:00.
Protection of intellectual property
All materials and resources available during the performance of the service or sent to the client after the performance of the service are the exclusive property of the Service Provider. They are subject to copyright as defined by the Law on Copyright and Related Rights (Journal of Laws of 1994, No. 24, item 83, as amended), trademark laws and/or other laws governing intellectual property rights.
The Client may record trainings and consultations that take place in online form.
Materials and resources, including audio and video recordings, textual elaborations may only be used by the Service Recipient for personal use.
The Service Recipient agrees: not to duplicate, share, distribute, modify, display, or publish the training (its content) to third parties, or sell the right to access the training.
In case of non-compliance with the provisions of this section, the Foundation has the right to discontinue the service, without refund.
Refund of the service fee
(1) A full refund is available in the following cases:
Cancellation of the contract by the Client under the terms of these regulations.
Inability to provide the service – we make a refund within 72 hours.
(2) Partial refund is possible only if the Foundation has begun to provide the service, but the service has not been performed with certainty. Partial refund can be made only with the consent of both parties. The amount of reimbursement is determined on the basis of the actual work performed and expenses incurred.
(3) If there is a need for reimbursement of funds for a transaction made by the client with a payment card, the Foundation will make the reimbursement to the bank account assigned to the client’s payment card.
Contact and Complaints
The Foundation uses due diligence to ensure the proper level of functioning of the Site. A user has the right to report concerns and errors in the functioning of the Foundation’s Site to: biuro@fresw.pl
The user using the services has the right to submit complaints regarding these services to: biuro@fresw.pl.
Notifications and complaints should include a detailed description of the problem occurring and the User’s contact information, enabling the Foundation to respond to the notification made by the User.
The Foundation may ask the User to provide additional information to the extent necessary to respond.
The Foundation will respond to the notification or complaint within 14 days of receiving the complete information.
Privacy Policy
Acting in accordance with Article 13 (1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (OJEU.L.2016.119.1), hereinafter referred to as:” RODO”, we inform you that the Administrator of your personal data is the Foundation for the Development of Central and Eastern Europe. Final provisions
The Client and the Foundation agree to keep confidential the information provided to them in the course of providing the service.
Placing an order with the Foundation is tantamount to acceptance of these regulations.
The condition for accessing the services provided by the Foundation is the use of a telephone and/or a device communicating with the Internet and equipped with a commonly used web browser.
The parties will strive to ensure that any disputes arising from cooperation between the User and the Foundation will be resolved amicably through negotiation.

The Foundation reserves the right to make changes to the Terms and Conditions.
